Is purchasing investment property under an LLC the best way to go and who sets up the LLC?
Often in my practice, I get asked whether an investor should prepare or create an LLC in order to purchase an investment property, and my answer is always yes. The reason to have an LLC hold title to the property is that God forbid anything ever happens, someone falls, someone sues you, the only thing they can go after is that property. If you’re holding it in your individual capacity, they can go after you individually and all assets that you own. So the LLC is always the best type of entity in order to hold title in Florida as an investor.
